The Haryana cabinet has approved a policy for granting one-time relief to unauthorised commercial constructions, and regularisation of illegal conversions -from residential to commercial in core areas. While unauthorised commercial constructions in Haryana are in for one-time relief, illegal conversions from residential to commercial in core areas, are set to get a window for getting these regularised, an official release said.

However, the one-time relief on both counts, will not be a blanket one and shall be subject to certain riders, it said. The policy has been framed to provide one-time relief so that unauthorised commercial constructions are brought in with conformity of the Building Code and relevant Acts or rules. Regularisation of unauthorised commercial construction, will be permitted for only 10 years and within these years, the applicant will have to construct or rectify his building as per the building bye-laws or code.

The department concerned will prepare an information technology-based platform to record all submitted information on unauthorised commercial constructions and prepare a complete central database which will scrutinise the building plans and prepare a report on violations. The report will be provided to the applicant who has to rectify construction within the given span of 10 years.

The state cabinet also approved an amendment to the Haryana Registration and Regulations of Societies Rules, 2012. At present, there is no provision under the rules with regard to the amount of transfer fee and maintenance charges. Any housing society in Haryana shall not charge more than Rs 10,000 as a transfer fee in case of change of ownership of apartment and shall fix the charges for maintenance of common area and facilities, on the basis of the size of the apartment, an official release said.

The amendment also allows for the extension of the time limit for obtaining a new registration number by the existing societies registered under the Societies Registration Act, 1860, and for fixing a transfer fee in respect of transfer of apartment and fixing of maintenance charges charged by governing body of the society formed by apartment owners.
