Assam RERA: Everything you need to know

The Real Estate Regulatory Authority (RERA) was established in each state and union territory under the RERA (Real Estate) Regulation & Development Act, 2016. In 2017, the RERA act came into effect in Assam. Initially, interim regulatory authorities were established in most states, including Assam. The government of Assam announced its decision to set up a permanent Real Estate Regulatory Authority and an interim tribunal by the end of January 2019.

The implementation of RERA in Assam witnessed a boost in the sale of residential properties as it increased the confidence of homebuyers. As per this act, all real estate projects must be registered with the state RERA, and promoters are required to provide complete information about their projects. The act also empowers homebuyers to file their complaints with the authority.

Currently, there are around 27 states and union territories with active RERA websites. However, the official Assam RERA website is yet to be launched. Here is all you need to know about Assam RERA and the registration process through offline mode.

Assam RERA registered projects: How to apply?

Developers/ promoters can apply for registration with the Assam RERA through offline mode as per the procedure mentioned below:

  • Visit the Assam RERA office and obtain the form for RERA registration in Assam from the relevant department.
  • In the application form, provide relevant details and attest it with signature.
  • Attach all the essential documents as specified in the form.
  • Submit the documents to the relevant authority. Pay the fees for the application process.
  • Get the acknowledgement slip and save it for future reference.
  • Once the payment for RERA registration has been made, the documents will be sent for verification.
  • The authority concerned will verify and approve the application and proceed with the registration process.
  • Applicants are required to visit the office to collect the RERA license.

Documents required

Promoters or companies are required to provide details such as name, photograph, contact details and address, incorporation certificate of the company, TAN card, Company Identification Number, Information about directors and shareholders, and information about the previous experience in real estate. They must provide the following documents:

  • Duly filled application form
  • PAN Card
  • ITR of the recent three years and balance sheets (audited)
  • Details related to the apartment, including carpet area, number of floors, parking space, etc.
  • Details related to the land, including rights, title and mortgage.
  • Project details, including location, sanctioned plan and layout plan and details related to architects, engineers and others.
  • Declaration by the developer of having a legal title of the land with relevant proof; or consent letter of the actual owner with documents (in case the developer is not the owner of the land)
  • Ownership documents (pro forma of allotment letter and agreement of sale).
  • Any other document, as specified by the RERA authority in the regulations.

Assam RERA: Registration process for real estate agents

To register as a real estate agent, one should fill an application form and submit it along with a registration fee and documents. Upon registration, real estate agents will receive a registration certificate with the registration number from the regulatory authority, which must be mentioned during every property sale.

Real estate agents are required to provide details such as name, registered address, type of enterprise, etc. They must provide the following documents:

  • Duly filled application form
  • PAN Card
  • Photograph
  • ITR of the recent three years and balance sheets (audited)
  • Particulars of registration, including memorandum of association, articles of association, etc.
  • Authenticated copy of address proof of the place of business
  • Any other document, as specified by the RERA authority in the regulations.

At the time of application for registration, they must pay a registration fee as mentioned below, through demand draft or online payment:

  • Rs 10,000 (if the applicant is an individual)
  • Rs 50,000 (if the applicant other than individuals)
